на оказание метрологических услуг

Общество с ограниченной ответственностью «А-Техникс» (ООО «А-Техникс»), именуемое в дальнейшем «Заказчик», в лице Генерального директора Коробовича Михаила Юрьевича, действующего на основании Устава, с одной стороны, и ________________ (_____________), именуемое в дальнейшем «Исполнитель», в лице ______________________, действующего на основании _____________________, с другой стороны, заключили настоящий договор (далее – «Договор») о нижеследующем:

ПРЕДМЕТ ДОГОВОРА
- Заказчик поручает, а Исполнитель принимает на себя оказание услуг по поверке, калибровке средств измерений («СИ»), предъявленных Заказчиком, аттестации испытательного оборудования («ИО»), а также связанных с ними дополнительных услуг (далее – «услуги по Договору»).
- Услуги по Договору оказываются Исполнителем.
- Услуги по Договору оказываются по согласованной Исполнителем письменной заявке Заказчика по форме Приложения №1 к настоящему Договору (далее – «Заявка»), которая становится приложением к Договору. В Заявке указываются метрологические характеристики СИ, характеристики ИО, срок их предъявления Заказчиком, стоимость и место оказания услуг.
- Перечень СИ, подлежащих поверке (калибровке) по Договору, их метрологические характеристики, перечень ИО, подлежащего аттестации, его характеристики, срок предъявления СИ (ИО) Заказчиком и место оказания услуг могут определяться согласованным сторонами Графиком поверки СИ, аттестации ИО (далее – «График»), который становится приложением к Договору. График составляется Заказчиком.
- Исполнитель оказывает услуги по поверке (калибровке) СИ в пределах установленной области аккредитации Исполнителя.
- Услуги по Договору оказываются Исполнителем в соответствии с Федеральным Законом от 26.06.2008г. № 102-ФЗ «Об обеспечении единства измерений», приказом Минпромторга России от 02.07.2015 г. № 1815 «Об утверждении порядка проведения поверки средств измерений, требования к знаку поверки и содержанию свидетельства о поверке», ПР50.2.016-94 «Требования к выполнению калибровочных услуг», ГОСТ Р 8.568-97, программами и методиками аттестации иными правилами по метрологии и утвержденными методиками поверки и калибровки.

СРОК ОКАЗАНИЯ УСЛУГ
- Срок оказания услуг по Договору в отношении каждого СИ (ИО), переданного (предъявленного) Заказчиком, составляет _________ (_________________) рабочих дней, если иные сроки не согласованы Сторонами в соответствующей Заявке. Срок оказания услуг может быть уменьшен Исполнителем в одностороннем порядке, без согласования с Заказчиком.
- Если в соответствии с утвержденной методикой поверки СИ необходимый для поверки срок составляет более согласованного Сторонами срока оказания услуг, срок оказания услуг по Договору в рабочих днях не должен превышать срока, определяемого методикой поверки, не считая дня передачи (предъявления) СИ Исполнителю и дня передачи СИ Заказчику.
- Течение сроков, установленных пунктами 2.1 – 2.2 Договора, начинается со дня, следующего за днем передачи (предъявления) СИ (ИО) Исполнителю.

Limited Liability Company “A-Technics” (LLC “A-Technics”) hereinafter referred to as the “Customer”, represented by the Director General Korobovich Mikhail Yuryevich acting on the basis of the Charter on the one hand, and ________________ (_____________), hereinafter referred to as the “Executor”, represented by ______________________, acting on the basis of _____________________, on the other hand, have concluded the present contract (hereinafter referred to as “the Contract”) on the following:

SUBJECT OF CONTRACT
- The Customer agrees to assign and the Executor agrees to provide services on verification and calibration of measuring instruments (MI), presented by the Customer, qualification of testing equipment (TE) and additional services related to them (hereinafter referred to as “Contract services”).
- Contract services are provided by the Executor.
- Contract services are delivered upon agreed by the Executor written requisition of the Customer according to the form given in Appendix No.1 to the present Contract (hereinafter referred to as the “Requisition”), which becomes an attachment to the Contract. The Requisition specifies metrological characteristics of MI, specifications of TE, date of their presentation by the Customer, cost and place of service provision.
- List of MI subject to verification (calibration) under the Contract, their metrological characteristics, list of TE, subject to qualification, its specifications, date of MI (TE) presentation by the Customer, and the place of service provision can be determined by the Schedule of MI verification and TE qualification agreed by the parties (hereinafter referred to as the “Schedule”), which becomes an attachment to the Contract. The Schedule is developed by the Customer.
- The Executor provides services on verification (calibration) of MI within the established scope of accreditation of the Executor.
- Contract services are provided by the Executor according to the Federal Law No.102-FZ dated 26.06.2008, “On assurance of measurement uniformity”, by the Order of the Ministry of Industry and Trade of the Russian Federation No.1815 dated 02.07.2015, "On approval of the procedure of conduct of MI verification, requirements to verification mark and contents of verification certificate’, PR50.2.016-94: “Requirements to the conduct of calibration services”, GOST R (Russian National Standard) 8.568-97, qualification programs and methods, other metrology rules and approved methods of verification and calibration.

SERVICE PROVISION PERIOD
- The service provision period under the Contract in respect to each MI (TE), handed over (presented) by the Customer shall be _________ (_________________) work days unless otherwise agreed by the Parties in the corresponding Requisition. The service provision period can be unilaterally reduced by the Executor without the consent of the Customer.
- If pursuant to the approved methods of MI verification the period necessary for verification is longer than the period of service provision agreed by the Parties, the period of service provision under the Contract in work days must not exceed the period established by the verification methods, not taking into account the day of handover (presentation) of MI to the Executor and the day of MI handover to the Customer.
- The periods, specified in clauses 2.1 – 2.2 of the Contract, shall start from the day after the date of handover (presentation) of MI (TE) to the Executor.
